Grading and other elements may be submitted in packages prior to vertical construction as contemplated by Section 7.1. Where a proposed development sets forth material modifications or variations from the Conceptual Development Plan (other than the relocation of use as described above), amendments to the Conceptual Development Plan shall require approval by Developer and the City, as further specified in the Design Declaration.
City and Developer intend that, pursuant to the Design Declaration, the Conceptual Development Plan will be approved as the POD Plan for the Development.
Developer acknowledges and agrees that it will be required to prepare and submit for approval by the Architectural Review Committee established under the Design Declaration, final development plan applications for the various phases of the overall development of the Project Site, in accordance with the Design Declaration and the provisions of this Agreement.
