Debar means to prohibit a contractor, individual, or other entity from submitting a bid, having a bid considered, or entering into a state contract during a specified period of time as set forth in a debarment order.
Debarred means: (A) debarred by the United States Food and Drug Administration (“FDA”) under 21 U.S.C. § 335a or by any other competent authority; (B) excluded, debarred, suspended, or otherwise ineligible to participate in the local or U.S. Federal health care programs or in local or U.S. Federal procurement or non-procurement programs; (C) listed on the FDA’s Disqualified and Restricted Lists for clinical investigators; or (D) convicted of a criminal offense that falls within the scope of 42 U.S.C. § 1320a-7(a) or applicable local Laws that could lead to being excluded, debarred, suspended, or otherwise declared ineligible. In the event Institution receives notice of, or otherwise becomes aware of, the Debarment or proposed Debarment of itself or any Institution Personnel, Institution shall notify AbbVie immediately and AbbVie shall have the right to immediately terminate this Agreement. The obligations of this Section 11(b) shall survive termination or expiration of the Agreement. b. Zdravotnické zařízení ujišťuje a zaručuje, že ani Zdravotnické zařízení ani Personál zdravotnického zařízení nejsou Vyloučenými osobami, ani podle nejlepšího vědomí a svědomí Zdravotnického zařízení nebyly Vyloučenými osobami a ani nejsou předmětem řízení, které by mohlo případně vést k vyloučení Zdravotnického zařízení nebo Personálu zdravotnického zařízení. Termín „Vyloučený“ pro účely této Smlouvy znamená: (A) vyloučený americkým Úřadem pro kontrolu potravin a léků („FDA“) podle 21 U.S.C. § 335a nebo jiným kompetentním orgánem; (B) vyloučený, s vysloveným zákazem nebo pozastavenou činností nebo jinak nezpůsobilý k účasti v místních nebo amerických federálních zdravotních programech či v místních nebo amerických federálních veřejných nebo neveřejných zakázkách; (C) zapsaný do seznamu FDA vyloučených klinických zkoušejících a klinických zkoušejících s omezením; nebo (D) odsouzený za trestný čin spadající pod 42 U.S.C. § 1320a-7(a) nebo platné místní Zákony, a toto odsouzení by mohlo vést k vyloučení, vyslovení zákazu či dočasného pozastavení, nebo k jinému prohlášení za nezpůsobilého. Pokud Zdravotnické zařízení dostane oznámení nebo se jinak dozví o Vyloučení nebo navrhovaném Vyloučení Zdravotnického zařízení jako takového nebo některého Personálu zdravotnického zařízení, ihned to společnosti AbbVie oznámí a AbbVie bude mít právo tuto Smlouvu s okamžitou platností ukončit. Závazek dle tohoto článku 11(b) zůstane v platnosti i po vypršení platnosti Smlouvy.
Tabarru ” means donation for the purpose of solidarity and cooperation among the Takaful Participants and to be used to help all Takaful Participants in times of misfortune. In the context of the Company, Tabarru’ will be allocated into the Participants’ Risk Fund.
Handler means a person who takes title to and is engaged in the operation of packing, cleaning, drying, packaging, sizing, hauling, grading, selling, offering for sale, or marketing a marketable agricultural commodity or an agricultural commodity input in commercial quantities as defined in a marketing program, who as owner, agent, or otherwise, ships or causes an agricultural commodity or agricultural commodity input to be shipped.
Debarment means an action taken by a Federal agency or official to exclude a person or business entity from participating in transactions involving certain federal funds.
