Debarred means: (A) debarred by the United States Food and Drug Administration (“FDA”) under 21 U.S.C. § 335a or by any other competent authority; (B) excluded, debarred, suspended, or otherwise ineligible to participate in the local or U.S. Federal health care programs or in local or U.S. Federal procurement or non-procurement programs; (C) listed on the FDA’s Disqualified and Restricted Lists for clinical investigators; or (D) convicted of a criminal offense that falls within the scope of 42 U.S.C. § 1320a-7(a) or applicable local Laws that could lead to being excluded, debarred, suspended, or otherwise declared ineligible. In the event Institution receives notice of, or otherwise becomes aware of, the Debarment or proposed Debarment of itself or any Institution Personnel, Institution shall notify AbbVie immediately and AbbVie shall have the right to immediately terminate this Agreement. The obligations of this Section 11(b) shall survive termination or expiration of the Agreement. b. Zdravotnické zařízení ujišťuje a zaručuje, že ani Zdravotnické zařízení ani Personál zdravotnického zařízení nejsou Vyloučenými osobami, ani podle nejlepšího vědomí a svědomí Zdravotnického zařízení nebyly Vyloučenými osobami a ani nejsou předmětem řízení, které by mohlo případně vést k vyloučení Zdravotnického zařízení nebo Personálu zdravotnického zařízení. Termín „Vyloučený“ pro účely této Smlouvy znamená: (A) vyloučený americkým Úřadem pro kontrolu potravin a léků („FDA“) podle 21 U.S.C. § 335a nebo jiným kompetentním orgánem; (B) vyloučený, s vysloveným zákazem nebo pozastavenou činností nebo jinak nezpůsobilý k účasti v místních nebo amerických federálních zdravotních programech či v místních nebo amerických federálních veřejných nebo neveřejných zakázkách; (C) zapsaný do seznamu FDA vyloučených klinických zkoušejících a klinických zkoušejících s omezením; nebo (D) odsouzený za trestný čin spadající pod 42 U.S.C. § 1320a-7(a) nebo platné místní Zákony, a toto odsouzení by mohlo vést k vyloučení, vyslovení zákazu či dočasného pozastavení, nebo k jinému prohlášení za nezpůsobilého. Pokud Zdravotnické zařízení dostane oznámení nebo se jinak dozví o Vyloučení nebo navrhovaném Vyloučení Zdravotnického zařízení jako takového nebo některého Personálu zdravotnického zařízení, ihned to společnosti AbbVie oznámí a AbbVie bude mít právo tuto Smlouvu s okamžitou platností ukončit. Závazek dle tohoto článku 11(b) zůstane v platnosti i po vypršení platnosti Smlouvy.
Debarred means (a) being debarred, or being subject to a pending debarment, pursuant to section 306 of the FD&C Act, 21 U.S.C. § 335a, (b) being listed by any federal or state agencies as excluded, debarred, suspended or otherwise made ineligible to participate in federal or state healthcare programs or federal procurement or non-procurement programs (as that term is defined in 42 U.S.C. § 1320a-7b(f)), or being subject to any pending process by which any such listing, exclusion, debarment, suspension or other ineligibility could occur, (c) being disqualified by any foreign government or regulatory agency from performing specific services, or being subject to a pending disqualification proceeding or (d) being convicted of or pleading nolo contendere to a criminal offense related to the provision of healthcare items or services or being subject to any pending criminal action related to the provision of healthcare items or services.
Debarred means, with respect to an individual or entity, that such individual or entity has been debarred or suspended under 21 U.S.C. §335(a) or (b), the subject of a conviction described in Section 306 of the FD&C Act, excluded from a federal or governmental health care program, debarred from federal contracting, convicted of or pled nolo contendere to any felony, or to any federal or state legal violation (including misdemeanors) relating to prescription drug products or fraud, the subject to OFAC sanctions or on the OFAC list of specially designated nationals, or the subject of any similar sanction of any Governmental Authority in the Territory.
