To Borrower’s actual knowledge, except as disclosed on the Current Survey no improvement or portion thereof, or any other part of any Mortgaged Property, is dependent for its access, operation or utility on any land, building or other improvement not included in such Mortgaged Property, other than for access provided pursuant to a recorded easement or other right of way establishing the right of such access.

If the box in § 9.1.1 or § 9.1.2 is checked, Buyer, the issuer of the Title Commitment 360 or the provider of the opinion of title if an Abstract of Title, and will receive an Improvement Location 361 Certificate, Improvement Survey Plat or other form of survey set forth in § 9.1.2 (collectively, Current Survey), on or before 362 Current Survey Deadline (§ 3).
