Where a Non-Painshare Collaborating Supplier or Other Authority Supplier has contributed to an End to End Service Level Failure, the Authority shall be deemed to the responsible Party solely for the purposes of calculation of the apportionment of responsibility between the Painshare Collaborating Suppliers as set out in paragraph 2 of this Schedule.

The Authority shall have the sole and absolute right to, at any time, agree with a third party that the third party will become a Painshare Collaborating Supplier or a Non-Painshare Collaborating Supplier for the purposes of this Agreement through the conclusion of an Accession Agreement in the form set out in Schedule 1 to this Agreement.
Example 3: If the Suppliers are unable to apportion responsibility between themselves, all Painshare Collaborating Suppliers each Painshare Collaborating Supplier will be liable for an End to End Service Credit of 5% of their Monthly Service Charge.
