The Operator understands and acknowledges the City desires on occasion to report to the citizens of Durham as to the financial performance of the DPAC and how much the City may collect as a result of either the City FF Share or the City Share of Operating Profit.
Notwithstanding the provisions of this Section 5.8 or the Legal Requirements, the Parties agree that the City shall be allowed to disclose to the public the contents of the Operator’s Annual Independent Audit report required by Section 5.7.
