Chargeable Delay definition

Chargeable Delay occurs when a confirmed Aircraft Inherent Malfunction directly results in an originating Scheduled Revenue Flight to be Dispatched more than [...***...] later than the scheduled time of departure.

Examples of Chargeable Delay in a sentence

  • A "Chargeable Delay" will be deemed to have occurred when, by more than fifteen (15) minutes and for reasons other than those defined under "Excluded Delay," a primary Aircraft Inherent Malfunction causes a Revenue Flight to depart later than the scheduled departure time.

  • Any delay which is not a Chargeable Delay is an "Excluded Delay." Excluded Delays are specifically excluded from this Guarantee, even if consequently the Aircraft is subject to a delay.

  • The Buyer will regularly submit Chargeable Delay data on a monthly basis not later than twenty (20) days after the end of the reporting month.

  • If, in the [***] of operation of the Aircraft fleet in commercial service, on average, an Aircraft available for dispatch has less than a [***]% ([***] percent) probability of being dispatched without a Chargeable Delay, [***] Guarantee, to the extent that [***].

  • The Seller guarantees that, from the first three-month Computation Period after the beginning of the *** year of operation of the Aircraft fleet in commercial service until the end of the Term, on average, an Aircraft available for dispatch will have a *** percent probability of being Dispatched without a Chargeable Delay.

  • Buyer's and Seller's Obligations The Buyer's and Seller's specialists will mutually agree on the details of a Chargeable Delay reporting procedure not later than three (3) months before delivery of the first Aircraft.

  • No Chargeable Delay and/or Cancellation with regard to a scheduled flight shall be counted if Buyer is reasonably able to maintain that scheduled flight without knowingly causing it to fail to maintain another scheduled flight.

  • Delay(s) or cancellation(s) of Scheduled Revenue Flights that result from a Chargeable Delay or Chargeable Cancellation.

  • The Seller guarantees that, for the [***] of operation of the Aircraft fleet in commercial service, on average, an Aircraft available for dispatch will have a [***]% ([***] percent) probability of being dispatched without a Chargeable Delay.

  • Excusable Delay means a delay due to acts of God, governmental restrictions, stays, judgments, orders, decrees, enemy actions, civil commotion, fire, casualty, strikes, work stoppages, shortages of labor or materials or other causes beyond the reasonable control of Borrower, but lack of funds in and of itself shall not be deemed a cause beyond the control of Borrower.

  • Excusable Delays means delays due to acts of terrorism, acts of war or civil insurrection, strikes, riots, floods, earthquakes, fires, tornadoes, casualties, acts of God, labor disputes, governmental restrictions or priorities, embargoes, national or regional material shortages, failure to obtain regulatory approval from any Federal or State regulatory body, unforeseen site conditions, material litigation by parties other than the Parties not caused by the Parties’ failure to perform, or any other condition or circumstances beyond the reasonable or foreseeable control of the applicable party using reasonable diligence to overcome which prevents such party from performing its specific duties or obligation hereunder in a timely manner.

  • Start-Up Costs means all fees, costs, and expenses incurred in connection with establishing the State Mitigation Trust and the Indian Tribe Mitigation Trust and setting them up for operation. Start-up costs shall not include the cost of premiums for insurance policies.

  • Contract Charges means charges that accrue during a given month as defined in Article III. “Contract Term” is defined in Article IV.

  • Unavoidable Delay means an event which delays Closing which is a strike, fire, explosion, flood, act of God, civil insurrection, act of war, act of terrorism or pandemic, plus any period of delay directly caused by the event, which are beyond the reasonable control of the Vendor and are not caused or contributed to by the fault of the Vendor. “Unavoidable Delay Period” means the number of days between the Purchaser’s receipt of written notice of the commencement of the Unavoidable Delay, as required by paragraph 5(b), and the date on which the Unavoidable Delay concludes.
