• The Parties understand and agree that such reimbursement, if any, shall be conditioned upon the Grantee’s receipt of CDBG Program funds from the federal government or accumulation of CDBG Program Income, as set forth in Section 38 and as a result of this Contract, and shall not be a charge on any other funds from the Grantee.

• Submit one copy of this form to the DOLA CDBG Program Coordinator with a copy of the applicable ▇▇▇▇▇-▇▇▇▇▇ wage decision and the written request from the employer naming the work classifications and wage rates that are proposed.

• For the purposes of annual audits, Subrecipient shall comply with 2 CFR Part 200 Subpart F for the State CDBG Program.

• Failure to fulfill these requirements shall subject the applicant or recipient, its subrecipients, and its successors, and assigns to those sanctions specified by the CDBG Program Agreement or contract through which Federal assistance is provided, and to such sanctions as are specified by 24 CFR Part 135, which include termination of this Agreement for default and debarment and suspension from future HUD-assisted contracts.

• The State reserves the right to add or delete terms and conditions of this Contract as may be required by revisions and additions or changes in the requirements, regulations, and laws governing the CDBG Program.
