Category A Activity definition

Category A Activity means any activity of a Client which is likely to have significant adverse environmental impacts that are sensitive, diverse or unprecedented;

  • The INP Activity is categorized under MCC’s Environmental Guidelines as a Category A Activity due to potentially significant environmental impacts anticipated to result from increased harvesting, utilization and export of species listed for protection under the Convention on the International Trade of Endangered Species (“CITES”).

More Definitions of Category A Activity

Category A Activity means any activity of an Eligible Sub-borrower which is likely to have significant adverse environmental impacts that are sensitive, diverse or unprecedented; “Category A Client” has the meaning set forth in Section 5.01 (m) (Affirmative Covenants); “Certificate of Incumbency and Authority” means a certificate provided to IFC by the Borrower in the form of Schedule 1; “Change of Control” any of the following: (i) any Person, other than one (1) or more of the Escasany, Ayerza and ▇▇▇▇▇ Family Members, (A) Controls or (B) owns, jointly or severally, directly or indirectly, any of the Capital Stock or any of the Voting Stock of EBA Holding S.A., (ii) the failure of EBA Holding S.A. to (A) Control and (B) own Voting Stock which (except for those matters for which class “A” shares of Grupo Galicia have the right to only one (1) vote) has the right to at least fifty-nine point forty-two percent (59.42%) of the total votes at shareholders meetings of Grupo Galicia, provided that such percentage may be reduced (without constituting a “Change of Control”) to a percentage of Voting Stock which (except for those matters for which class “A” shares of Grupo Galicia have the right to only one (1) vote) has the right to cast a majority of the votes at shareholders meetings of Grupo Galicia in the event that Grupo Galicia issues equity securities by reason of any transaction not prohibited under the terms of this Agreement or any Transaction Document (including, without limitation, the issuance of equity by the Borrower), and/or (iii) the failure of Grupo Galicia to (A) Control the Borrower and (B) to own at least ninety-three percent (93%) of the Capital Stock and Voting Stock of the Borrower; provided that such percentage may be reduced (without constituting a “Change of Control”) to sixty-five percent (65%) of the Capital Stock and Voting Stock of the Borrower in the event that the Borrower issues equity securities by reason of any transaction not prohibited under the terms of this Agreement or any of the Transaction Documents (including, without limitation, the issuance of equity by the Borrower);

Category A Activity means any activity of the Company which is likely to have significant adverse, irreversible social or environmental impacts that may extend beyond the boundaries of an actual project site or facility are sensitive, diverse, irreversible or unprecedented such as business activity that may include a) involuntary resettlement (including physical and economic displacement), b) risk of adverse impacts on indigenous peoples, c) significant risks to or impacts on the environment, community health and safety, biodiversity, cultural heritage, d) significant occupational health and safety risks, or e) environmental and/or social risks that may extend beyond the boundaries of an actual project site or facility.
