Chief Capper shall provide a report to the Board of his vacation and sick leave accruals (including hours used and remaining) at least semi- annually and the Board may direct him to take vacation at any time during the Term of this Agreement.
The District shall indemnify and defend Chief Capper against any claim, demand, or action arising out of an alleged act or omission occurring in the performance of his duties, except that the District shall have no such duty if he acted or failed to act because of fraud, corruption, or malice, or willfully fails or refuses to conduct the defense of the claim, demand, or action in good faith or to reasonably cooperate with the District in defense of the claim, demand, or action in good faith.
Chief Capper may terminate voluntarily by way of resignation or retirement.
Chief Capper shall be entitled to vacation, sick leave, other leaves of absence, and holidays as set forth in Sections 3 through 6 of that Memorandum of Understanding for Members of the Executive Staff of the District for the period July 1, 2020 through June 30, 2023.
Notwithstanding the foregoing, Chief Capper acknowledges that he does not have a “property interest” in continued employment with the District in any capacity and that the obligations of the District to Chief Capper are solely contractual or as otherwise required by law.
Chief Capper shall make every effort to give the District the courtesy of at least 45 days’ notice of resignation or retirement.
Chief Capper shall disclose all outside employment (including self-employment), even if it does not appear that the activity will interfere with the performance of his duties.
Additionally, the District shall provide Chief Capper with a District-owned vehicle and mobile devices for his day-to-day business use and to enable him to respond to calls and other matters requiring his prompt or immediate attention including afterhours and on weekends.
