Available for distribution definition

Available for distribution means that the HCT/P has been determined to meet all release criteria (§ 1271.3(z)). Distribution means any conveyance or shipment (including importation and exportation) of an HCT/P that has been determined to meet all release criteria, whether or not such conveyance or shipment is entirely intrastate (§ 1271.3(bb)). If an entity does not take physical possession of an HCT/P, the entity is not considered a distributor (§ 1271.3(bb)).
Available for distribution. As defined in Section 3.2.
Available for distribution means that the amount in question (i) has been or is being distributed to Borrower or (ii) upon the request of Borrower will be distributed to Borrower without restriction, deduction or offset. Authorized Representatives as defined in Section 4 and listed on Exhibit C.

Available for distribution means (i) cash proceeds from the liquidation of assets held by Exponential, and Exponential's pro rata portion of the cash proceeds from the liquidation of assets held by Exponential LP or Exponential LLC, to the extent that such entities may legally distribute such cash to their equity holders, plus (ii) all cash actually distributed to Newtek from such sources. . "Initial Recovery" shall mean $1,000,000, plus simple interest on such amount at a rate of ten percent per annum, calculated quarterly; provided, however, that interest shall accrue only on the portion of the Initial Recovery that is not yet Available for Distribution, also calculated quarterly.
