ASML Licensed Products definition
ASML Licensed Products is defined in Section 1.3.1
ASML Licensed Products means Lithography Equipment and all applications therefor, but excluding Optical Components until the occurrence of a Licensed Product Expansion, at which time the term “ASML Licensed Products” shall automatically be deemed to mean “Lithography Equipment and all applications therefor, including Optical Components” for all purposes hereunder, including the license grants in Section 2.1, as more fully described in, and subject to the conditions set forth in, Section 2.10. For purposes of clarity, “ASML Licensed Products” shall in all events include ASML’s products within the following product families, as and in the form marketed by ASML as of the Effective Date: TwinScan, PAS, MicraScan and Micralign series, including components thereof, as described in Section 1.3.5, other than Optical Components as long as they are not ASML Licensed Products pursuant to this Section 1.3.1.
ASML Licensed Products shall automatically be deemed to mean “Lithography Equipment and all applications therefor, including Optical Components” for all purposes hereunder, including the license grants in Section 2.1 and the immunities and other commitments extended by Nikon and its Subsidiaries under this Agreement (the “LICENSED PRODUCT EXPANSION”); provided, however, that (i) as a condition of such modification to the term “ASML Licensed Products”, ASML shall assume responsibility to pay any of the Zeiss SMT Payments that Zeiss SMT has not paid to Nikon at the time of such modification, which amount(s) ASML shall pay within thirty (30) days following the later of the due date therefor or Nikon’s notice to ASML thereof, and (ii) the scope of ASML’s rights under this Agreement with respect to Optical Components shall not exceed the scope of a permissible sublicense to ASML under the Nikon-Zeiss Patent-Cross License Agreement, as it exists as of the Effective Date, as described therein. *** - indicates material omitted pursuant to a confidential treatment request and filed separately with the Securities and Exchange Commission.

Nikon, on its own behalf and on behalf of its other Grantor entities, grants to ASML and its Subsidiaries, a worldwide, non-exclusive, non-sublicensable, non-transferable license, under Nikon’s Licensed Patents, to make, have made, use, sell, offer for sale, and import ASML Licensed Products during the Term, and permanently for any Converted Licensed Patent family.
The listing of any information in this Schedule 6.3.2 shall not be deemed an admission or acknowledgment that such information is required to be listed in this Schedule 6.3.2. Without limiting the foregoing, the listing of any Patent in this Schedule 6 3 2 shall be deemed to be an inclusion of the claim(s) of such Patent in this Schedule 6.3.2 only if, and to the extent, that such claim(s) are reasonably relevant to ASML Licensed Products or Zeiss Licensed Products.
More Definitions of ASML Licensed Products
ASML Licensed Products means lithography equipment (including EUV Lithography Products) and components for use in lithography equipment (including EUV Lithography Products) that are designed, made, have made, used, sold, offered for sale, or imported by or on behalf of ASML or its Subsidiaries, and all applications therefor, as well as such other products as may be agreed by the parties; but excluding ASML Excluded Products and components for ASML Excluded Products. For purposes of clarification, lithography equipment and components licensed pursuant hereto are licensed in their entirety, including any third-party components and materials thereof or therefor that were not designed by or for ASML or its Subsidiaries.
ASML Licensed Products means Lithography Equipment and Lithography Components, and, in each case, all applications therefor; provided, however, that ASML Licensed Products exclude (a) ASML Excluded Products and (b) Components that are solely for use in ASML Excluded Products. For the avoidance of doubt, Lithography Equipment and Lithography Components are licensed in their entirety, including any Third Party Components thereof. Without limiting the generality of the foregoing, as of the Effective Date, “ASML Licensed Products” include ASML’s and its Grantee Entities’ products within the following product lines: TWINSCAN NXE (including TWINSCAN NXE 3400B, TWINSCAN NXE 3350B, and TWINSCAN NXE 3300B); TWINSCAN NXT (including TWINSCAN NXT 2000i, TWINSCAN NXT ▇▇▇▇▇▇, ▇▇▇▇▇▇▇▇ NXT 1970Ci, and TWINSCAN NXT 1965Ci); and TWINSCAN XT (including TWINSCAN XT 1460K, TWINSCAN XT 1060K, TWINSCAN XT860M, and TWINSCAN XT400L).
