Applicable Information definition

Applicable Information means: (A) the name and address of the Partnership; (B) the fact that the BCIMC Limited Partner is a Limited Partner in the Partnership; and (C) a brief description of the Partnership’s general investment strategy (which will be limited to the information set forth in Article 2 hereof); provided, that with respect to any such information that has been independently produced by the BCIMC Limited Partner, including based on information provided by the General Partner, the BCIMC Limited Partner agrees to include language stating, or otherwise disclosing, that such information has been independently prepared by the BCIMC Limited Partner.
Applicable Information means information regarding whether-- • the name (including first name and any family forename or surname), • the date of birth (including month, day, and year), and • the last 4 digits of the individual’s SSN match the information contained in SSA’s records, and • such individual is shown on the records of SSA as being deceased. Section 303(a)(5)(C) (as codified at 42 U.S.C. §405(r)(8)(C)-(D)), also provides that SSA shall develop methods to verify the accuracy of information provided by the respective MVAs, and that the “applicable information” will be matched with the information contained in SSA’s records. SSA will make appropriate efforts to provide verifications by comparing the information provided by the applicant with information in SSAs Master Files of Social Security number (SSN) Holders and Applications data base. However, because SSA’s enumeration records are based on a complete and unique 9 digit SSN, verifications using only the last 4 digits of that number are inherently a partial rather than the full “9-digit” verification and may result in multiple positive matches or false positive matches of information.
Applicable Information shall have the meaning assigned thereto in Section 10.04(b).

Applicable Information means all documentation, data and other information, whether written, oral or election form, or retained in the memory of any individual, (i) that is held by, or included in the assets of, any of the Acquired Companies at the Closing (the “Acquired Company Information”), or (ii) that is Retained Information but otherwise relates to the business of any Acquired Company, including any TSA Information (the “Applicable Retained Business Information”). Sellers acknowledge that Buyer and its Affiliates have a compelling business interest in preventing unfair competition with Buyer and its Affiliates stemming from the intentional or inadvertent use or disclosure of the Applicable Information.

  • Tangible Information means information that is contained in written, electronic or other tangible forms.
