Related to and Structured Notes

Existing Unsecured Notes the Borrower’s 11.5% Senior Notes due 2018, issued pursuant to the Existing Unsecured Indenture, outstanding on the Closing Date or subsequently issued in exchange for or in respect of any such notes.
Unsecured Notes means any senior unsecured notes, subordinated unsecured notes or senior subordinated unsecured notes, in each case, issued by the Borrower or a Guarantor in one or more transactions.
Additional Senior Notes means any Senior Notes (other than Initial Senior Notes and Senior Exchange Notes) issued under the Senior Notes Indenture in accordance with Sections 2.02 and 4.10 thereof, as part of the same series as the Initial Senior Notes or as an additional series.
Senior Note Indenture means the Indenture, dated as of March 15, 1994, among the Borrower and Corestates Bank, N.A., as trustee, as in effect on the Effective Date and as amended, modified or supplemented from time to time in accordance with the terms hereof and thereof.
Holdco Notes means the $1,000,000,000 aggregate principal amount of 11 1/2% Senior PIK Notes due 2016 issued by Holdings.
