Additional Senior Notes definition

Additional Senior Notes shall have the meaning assigned to such term in Section 11.2(b).

Additional Senior Notes means senior notes issued by the Borrower after the Closing Date in compliance with this Agreement having substantially the same terms in all material respects (other than pricing and maturity) as the Senior Notes or terms more favorable to the Borrower.

Additional Senior Notes means any additional Senior Notes (other than Initial Senior Notes) issued from time to time under this Fifth Supplemental Indenture in accordance with Section 2.04 of the Base Indenture, as a part of the same series as the Initial Senior Notes; provided, that no Additional Senior Notes may be issued during the continuance of a Default or an Event of Default.

Examples of Additional Senior Notes in a sentence

• The aggregate principal amount of the Additional Senior Notes, if any, shall be unlimited.

• No Additional Senior Notes may be issued if an Event of Default under the Indenture has occurred and is continuing with respect to the Senior Notes.

• Any Additional Senior Notes, together with the Senior Notes, will constitute a single series of Securities under the Indenture.

• Such Additional Senior Notes, at the Company’s determination and in accordance with the provisions of the Indenture, will be consolidated with and form a single series with the previously outstanding Senior Notes for all purposes under the Indenture, including, without limitation, amendments, waivers and redemptions.

• The Additional Senior Notes shall initially be evidenced by one or more Global Notes, substantially in the form of Exhibit A hereto.

More Definitions of Additional Senior Notes

Additional Senior Notes means up to $25 million aggregate principal amount of Senior Notes (other than the Initial Senior Notes) issued under this Indenture in accordance with Sections 2.02 and 4.09 hereof, as part of the same series as the Initial Senior Notes.

Additional Senior Notes means any Senior Notes issued under the terms of the Senior Note Indenture subsequent to the Closing Date.

Additional Senior Notes means any Senior Notes (other than Initial Senior Notes and Senior Exchange Notes) issued under the Senior Notes Indenture in accordance with Sections 2.02 and 4.10 thereof, as part of the same series as the Initial Senior Notes or as an additional series.

Additional Senior Notes shall have the meaning provided in the Credit Agreement.

Additional Senior Notes means any Senior Notes issued under the terms of this Senior Notes Indenture subsequent to the Issue Date, it being understood that any Senior Notes issued in exchange for or replacement of any Original Senior Note issued on the Issue Date shall not be an Additional Senior Note, including any such Senior Notes issued pursuant to a Senior Notes Registration Rights Agreement.

Additional Senior Notes has the meaning set forth in Section 2.01.

Additional Senior Notes means additional Senior Notes that are issued under a supplemental indenture after the date that Senior Notes are first issued by the Company and authenticated by the Trustee under this Supplemental Indenture, which will rank pari passu with the Senior Notes initially issued in all respects, and shall be consolidated and form a single series with the Senior Notes and shall have the same terms as to status, redemption or otherwise as the Senior Notes.
