Additional 2013 Notes definition

Additional 2013 Notes means 4.625% Senior Notes due 2013 issued from time to time after the 2013 Note Issue Date under the terms of this Indenture (other than pursuant to Section 2.8, 2.9, 2.11 or 10.7 of this Indenture).

Additional 2013 Notes means an unlimited amount of 2013 Notes (other than the Initial 2013 Notes) issued under this Indenture in accordance with Section 3.3, as part of the same series as the Initial 2013 Notes.

Examples of Additional 2013 Notes in a sentence

  • The 2013 Notes and any such Additional 2013 Notes would rank equally and ratably.

  • Additional 2013 Notes issued in this manner will be consolidated with, and will form a single series with, the 2013 Notes, unless such Additional 2013 Notes will not be treated as fungible with the 2013 Notes for U.S. federal income tax purposes.

  • Additional 2013 Notes issued in this manner shall be consolidated with and shall form a single series with the previously outstanding 2013 Notes.

  • The Exchange 2013 Notes, any Additional 2013 Notes issued other than as Transfer Restricted Notes and the Trustee's certificate of authentication for each shall each be substantially in the form of EXHIBIT D hereto, which is hereby incorporated in and expressly made a part of this Indenture.

  • All Initial 2013 Notes and Additional 2013 Notes, if any, all Initial 2015 Notes and Additional 2015 Notes, if any, and all Initial 2020 Notes and Additional 2020 Notes, if any, will each be treated as a single class for all purposes of this Indenture, including waivers, amendments, redemptions and offers to purchase.

  • 2013 Notes means the 4.375% Senior Secured Notes due 2023 and the 5.950% Senior Secured Notes due 2043 issued by the Issuer on March 18, 2013.

  • 2019 Notes has the meaning set forth in the definition of “2018 Exchange Offers”.

  • 2014 Notes means the aggregate principal amount of US$399,517,000 of 10.25% Guaranteed Senior Notes Due 2014 issued pursuant to the 2014 Note Indenture.

  • Additional Senior Notes means any Senior Notes (other than Initial Senior Notes and Senior Exchange Notes) issued under the Senior Notes Indenture in accordance with Sections 2.02 and 4.10 thereof, as part of the same series as the Initial Senior Notes or as an additional series.

  • 2022 Notes means the 5.875% Senior Notes of the Company due August 14, 2022 issued under the 2022 Indenture.
