This Throughput and Tankage Agreement (this “Agreement”) is dated as of February 10, 2014 by and between Lion Oil Company, an Arkansas corporation (“Lion”), and Delek Logistics Operating, LLC, a Delaware liability company (“Logistics”), and, for the limited purposes specified in Section 22, J. Aron & Company, a New York general partnership (“J. Aron”). Each of Lion and Logistics are individually referred to herein as a “Party” and collectively as the “Parties.”

This Throughput and Tankage Agreement (this “Agreement”) is dated as of July 26, 2013 by and between Delek Refining, Ltd., а Texas limited partnership (“Refining”), and Delek Marketing & Supply, LP, a Delaware limited partnership (“Logistics”). Each of Refining and Logistics are individually referred to herein as a “Party” and collectively as the “Parties.”

This Amendment to Throughput and Tankage Agreement (this “Amendment”) is entered into as of July 22, 2016, but effective as of February 11, 2014, by and between Lion Oil Company, an Arkansas corporation (“Lion”), and Delek Logistics Operating, LLC, a Delaware limited liability company (“Logistics”). Lion and Logistics are hereinafter sometimes referred to individually as a “Party” and collectively as the “Parties.”

THIS FIRST AMENDMENT TO THROUGHPUT AND TANKAGE AGREEMENT (this “Amendment”), dated as of December 14, 2018, is made and entered into by and between LION OIL COMPANY, an Arkansas corporation (the “Company”), DELEK LOGISTICS OPERATING, LLC, a Delaware limited liability company (the “Operator”, and together with the Company, collectively, the “Parties” and each individually a “Party”).Capitalized terms used and not otherwise defined in this Amendment shall have the meanings assigned to such terms in the Agreement (as hereinafter defined).
