This Support Addendum is governed by and between the Master Terms and Conditions and Order Form between the Dalet party identified on the Order Form (“Dalet”), and the Company identified on the Order Form (this Support Addendum, together with the Master Terms and Conditions, the Order Form, and any other addenda, the “Agreement”). By having access to, receiving, and/or using the Services, Company agrees, without limitation or qualification, to be bound by and to comply with the Agreement. In the event of any conflict between this Support Addendum and any Order Form, the Order Form shall control.

This Support Addendum (“Addendum”) is made pursuant to the Nutanix End User License Agreement (“Agreement”). The terms of the Agreement shall, from the Effective Date of this Addendum, apply to this Addendum and the Nutanix Support.

This Trintech Support Addendum (“Addendum”) is made a part of the Subscription Services Agreement (the “Agreement”) between Trintech and Subscriber found at https://www.trintech.com/terms-and-conditions/cadency/. All capitalized terms used but not defined herein will have the meanings assigned to them in the Agreement. This Addendum may be updated from time to time by Trintech in its sole discretion provided that such updates will not materially reduce the 99.9% Availability of Supported Services or other associated obligations of Trintech.

For clarity, “Customer” is the specific entity listed on the Referencing Agreement and does not include parents, subsidiaries, or any other affiliated entities (unless specifically listed in the Referencing Agreement). Capitalized terms used but not defined in this document have the meanings assigned to them in the Referencing Agreement.
