This Supplier Data Protection Addendum (“DPA” or “Addendum”) is hereby incorporated by reference into the agreement between the applicable Everest Group entity/entities and the applicable Supplier entity/entities and is an addendum to the Terms of Purchase (the “Agreement”). By entering into the Agreement, this DPA is agreed to by the parties and the parties are deemed to have signed this DPA. All provisions of the Agreement, including its limitations of liability, apply to and are incorporated into this DPA. If there is a conflict between the provisions of this DPA and any provisions in the Agreement, then the provisions of this DPA shall control.
