RAILWAY AND PORT (THE PILBARA INFRASTRUCTURE PTY LTD) AGREEMENT BILL 2004

This is the first of two agreements that the Government intends to make for the Pilbara iron ore and infrastructure project. The other agreement is for iron ore mining operations in the vicinity of the Chichester Range, which the Government will negotiate with FMG Chichester Pty Ltd. The agreement, if ratified by Parliament, will not come into effect until all parties to the mining agreement have signed the mining agreement. FMG has stated that it intends to dilute its interest in TPI to no more than 40 per cent, so the mining and infrastructure components of the Pilbara iron ore and infrastructure project will be separately funded and managed. The Government anticipates that the multi-user railway and port facilities to be developed under the Railway and Port (The Pilbara Infrastructure Pty Ltd) Agreement will open the Pilbara iron ore industry to new entrants seeking to supply growing demand for iron ore, especially from China.

HON JON FORD (Mining and Pastoral) [10.30 pm]: The opposition supports this bill. In short, the bill deals with the expansion of two businesses, one being The Pilbara Infrastructure Pty Ltd. We have had a lot of debate in this house about third parties accessing rail lines. TPI enables that. In his second reading speech the minister talks about Atlas Iron being assisted by this company in the export of 1.6 million tonnes of iron ore and that BC Iron should commence transporting ore on TPI’s railway by the end of the year. This bill is a bread-and-butter variation to assist this company to develop its business. From Fortescue Metal Group’s perspective, TPI is a very important, not so new, player that most people would say is here to stay. The bill is particularly required because, as the minister pointed out in the previous debate, a private railway cannot be built without an agreement act. This allows the Fortescue Metals Group to join its business together to facilitate a spur line. I

The opposition will be supporting this bill, of course. This bill is a flow-on from an agreement between the government and Fortescue Metals Group Ltd to facilitate the continuation of Fortescue’s iron ore operations in the Pilbara. We know that one of the challenges with the iron ore industry is that iron ore companies always need to find additional ore bodies that they can extract and develop. This bill will enable that to take place. Some of Fortescue’s existing ore bodies have a limited life, as is the case with most mines, and some will come to an end more imminently than others. Fortescue has found a new resource at Eliwana. In order to extract and export that resource, it needs to build a rail spur to that ore body. This agreement bill will provide authority under the Land Administration Act 1997 for Fortescue Metals Group to identify, map out and prepare the optimal route for the rail line to that ore body.

To avoid doubt, it is declared that the provisions of the Public Works Act 1902 section 96 do not apply to the railway constructed pursuant to the Agreement.

HON ROBIN CHAPPLE (Mining and Pastoral) [5.10 pm]: Earlier I referred to the location of the rail line. I have a map here that shows the alignment of the railway line around Spear Hill. For those members who can see the map, Spear Hill is here. Unfortunately, the rail line will pass through all these sites, whereas the corridor is two kilometres wide. If the rail line was to go the other side of the corridor, it would miss all those sites. It would be a very simple thing to do.
