SETTLEMENT AGREEMENT (this “Agreement”) is made by and between the TOWN OF MARANA, an Arizona municipal corporation (the “Town”) and TAPESTRY PROPERTIES III, L.L.C., an Arizona limited liability company (the “Property Owner”). The Town and the Property Owner are collectively referred to in this Agreement as the “Parties,” either of which is sometimes individually referred to as a “Party.”
