THIS AMENDED AND RESTATED PREFERRED EQUIPMENT SUPPLY AGREEMENT (this “Agreement”) dated as of December 27, 2010 (the “Effective Date”), is executed and entered into by and between BrightSource Energy, Inc., a Delaware corporation (“BSE”), for itself and on behalf of its Affiliates including BrightSource Industries (Israel), Ltd.
