Definitions: In this part of this Agreement the words “you”, “your”, “Depositor”, and the “Customer” mean the account holder(s). If there is more than one account holder, then these words mean all account holders’ jointly and severally as indicated herein. The words “we”, “us”, and “our” mean New Direction IRA Inc. The word “Account Representative” means any individual the Customer has delegated his or her investment responsibilities. The word “in writing” includes, subject to any limitations contained in Treasury Regulation section 1.401(a)-21 and any other applicable federal or state law or regulation, Depositor acknowledges and agrees that the Custodial Account shall be subject to the provisions of the Uniform Electronic Transactions Act, as passed in the state of Kansas, and the federal Electronic Signature in Global and National Commerce Act (ESIGN Act, as contained in 15 U.S.C. 7001), as those laws pertain to electronic communication, electronic signatures, and electronic storage
