This Mobile Remote Deposit Capture User Agreement (“Agreement”) contains the terms and conditions for the use of the Mobile Check Deposit Service (“Service”) provided by Evans Bank. Each reference in this Agreement to “Evans Bank”, the “Bank”, “we”, “us”, or “our” refers to Evans Bank, a federally chartered community bank, and each reference to “you” and “your” refers to the Customer, party to this Agreement. Other agreements you have entered into with Evans Bank, including the Deposit Account Agreement and Disclosure, Consumer/Small Business Online Banking Service Agreement and Disclosures governing your Evans Bank account(s), are incorporated by reference and made a part of this Agreement. Terms used but not defined in this Agreement shall have their respective meanings herein as set forth in the Master Agreement.
