Whereas this contract is herein entered into between the Board of School Directors of the Orange, Washington, and Williamstown School Districts, hereinafter to be known as the “Boards,” and the Orange North Education Association, hereinafter to be known as the “Association,” which Contract shall become effective upon ratification and execution by both parties and shall continue through June 30, 2018, with such exceptions as may be herein noted.

In accordance with 12 V.S.A. § 5652(b), the Boards and the Association understand that this Agreement contains an agreement to arbitrate. After signing this Agreement, the Boards and the Association understand that they will not be able to bring a lawsuit concerning any dispute that may arise which is covered by the arbitration agreement, unless it involves a question of constitutional or civil rights. Instead, the parties agree to submit any such dispute to an impartial arbitrator in accordance with the provisions contained in Article 16.

IN ACCORDANCE WITH 12 V.S.A. §5652(B), THE BOARDS AND THE ASSOCIATION UNDERSTAND THAT THIS AGREEMENT CONTAINS AN AGREEMENT TO ARBITRATE. AFTER SIGNING THIS AGREEMENT, THE BOARDS AND THE ASSOCIATION UNDERSTAND THAT THEY WILL NOT BE ABLE TO BRING A LAWSUIT CONCERNING ANY DISPUTE THAT MAY ARISE WHICH IS COVERED BY THE ARBITRATION AGREEMENT, UNLESS IT INVOLVES A QUESTION OF CONSTITUTIONAL OR CIVIL RIGHTS. INSTEAD, THE PARTIES AGREE TO SUBMIT ANY SUCH DISPUTE TO AN IMPARTIAL ARBITRATOR IN ACCORDANCE WITH THE PROVISIONS CONTAINED IN ARTICLE XII, GRIEVANCE, IN THIS CBA.
