This Intergovernmental Agreement Regarding Water Supply Facilities, Design, Construction, And Operation is dated , 2008 (the “Agreement”), by and between the City of Lake Oswego (“Lake Oswego”), an Oregon municipal corporation and the City of Tigard (“Tigard”), an Oregon municipal corporation. Lake Oswego and Tigard may also be referred to individually herein as a “Party” and collectively as the “Parties.”

AND USE OF DISTRICT RESERVE FUND (the “Agreement”) is made and entered into by and among COUNTY OF OURAY COLORADO, a body politic and corporate (the “County”) and the COLORADO NEW ENERGY IMPROVEMENT DISTRICT, an independent public body corporate formed in accordance with Section 32-20-104, C.R.S. (the “District”) (individually, a “party” and collectively, the “Parties”), and shall be effective on the Effective Date of this Agreement as that term is defined below.
