This Helios Online Subscription Agreement (“Agreement”) is between Tx3 Services, LLC (“Tx3”), and the legal entity identified on one or more order forms, purchase orders, or similar documents (“Customer”), that incorporate this Agreement by reference (collectively, “Orders”). This Agreement governs Customer’s access and use of the application software hosting platform known as Tx3 “Helios” (“Platform”), under the terms and conditions set forth below. The specifics of the Platform and the third-party dev-ops tools to be hosted in it (“Software”) will be set forth in the applicable Order. By accessing or using the Platform, Customer acknowledges that it haread and understands this Agreement, that it accepts all of the terms and conditions contained here in full, and that it agrees that the terms and conditions shall be fully and legally binding upon it, without the need for any further indication of acceptance on its part (such as by signature, click through or other means of electronic
