This Proportionate Fair Share Agreement (this “Agreement”) is entered into by and between the following entities: Lois Realty Corp., a Florida corporation (“Owner”), mailing address: c/o Rooms To Go 400 Perimeter Center Terrace, Suite 800 Atlanta, GA 30346-1235; The City of Daytona Beach, a Florida municipal corporation (“City”), mailing address: 301 S Ridgewood Avenue Daytona Beach, FL 32114, and The County of Volusia, a political subdivision of the State of Florida (“County”), mailing address: 123 West Indiana Avenue, DeLand, FL 32720. This Agreement is dated and effective as of the date executed by the last of the Owner, the City and the County (the “Effective Date”).
