This End-User License Agreement (this "EULA") is a legal agreement between you ("Licensee") and Viocle LLC, DBA HeartbeatRM ("Licensor"), the author and provider of Heartbeat Remote Management and HeartbeatRM software and services, including all HTML files, Javascript files, graphics files, animation files, data files, technology, development tools, scripts, and programs, both in object code and source code (the "Software"), the deliverables provided pursuant to this EULA which may include associated media, printed materials, and "online" or electronic documentation. Hereinafter "Service(s)" means the HeartbeatRM services set forth in the applicable documentation and may include professional services, maintenance services and Software provided as a service in a ("Hosted Environment") HeartbeatRM or third party owned computer system on which the Software or API is installed and made available for remote use by the Licensee.
