Transportation by Hyannis Air Service, Inc. d/b/a Cape Air/Nantucket Airlines (“Cape Air”) is subject to the terms and conditions contained in this Contract of Carriage, in addition to any terms and conditions printed on or in any ticket, ticket jacket, web site or ticket receipt. To the extent there is a conflict between this Contract of Carriage and any terms and conditions printed on or in any ticket, ticket jacket, web site or ticket receipt, this Contract governs. By purchasing a ticket or accepting transportation, each Passenger agrees to be bound thereby. A copy of this contract may be obtained from any Cape Air airport ticket counter or city ticket office, through calling our Contact Center at 1-800-CAPEAIR (227-3247) or (508) 771-6944 (outside the US and USVI), by accessing our web site at www.capeair.com or by contacting Cape Air at 660 Barnstable Road, Hyannis, MA 02601 (Attn: Customer Care).

Transportation of passengers, baggage, and freight on flights operated by Southern Airways Express, LLC under the “Southern Airways Express” or “Mokulele Airlines” brand names, collectively called “Carrier,” is subject to the terms and conditions as established in this Contract of Carriage, in addition to any other printed conditions on any electronic ticket receipt or itinerary. Purchase of a ticket or accepting travel on Carrier is a binding agreement to accept all terms.

When you purchase a ticket, book a reservation or accept transportation on and with Seaborne Airlines (“Seaborne”), you enter into a contract. This contract is called a “CONTRACT OF CARRIAGE”. Each Passenger agrees to be bound by all of the terms and conditions set forth in this contract.

The purchaser of this Contract of carriage accepts for himself or herself and on behalf of any other person or child traveling under this ticket, including the owner of any vehicle carried hereunder, as well as the heirs and representatives of any person aforementioned, the terms and conditions herein and the terms and conditions contained in the Carrier's tariff (available for inspection on request).
