THIS AGREEMENT (hereinafter the “Contract” or the “Agreement”) is made by and between the People of the State of New York, acting by and through the Commissioner of the New York State Office of General Services (“OGS”), acting pursuant to authority granted under State Finance Law §163, whose office is on the 41st Floor, Tower Building, Governor Nelson A. Rockefeller Empire State Plaza, Albany, New York 12242 (hereinafter “OGS” or “State”), and Emerling Chevrolet Inc. (“Emerling” or “Contractor”) with offices at 9000 Boston State Road, Boston, NY. OGS and the Contractor are collectively referred to herein as “the Parties.”
