This revised AGREEMENT (“Second Amended Agreement”), made and entered into on this 13th day of November, 2020, by and between the UNITED STATES OF AMERICA, represented by the Secretary of Energy, acting by and through the Administrator, Western Area Power Administration (“Western”), an Administration within the Department of Energy, and SOUTHWEST POWER POOL, INC. (“SPP”), incorporated as a not-for-profit corporation in the State of Arkansas, acting in its capacity as a Regional Transmission Organization (“RTO”), and acting through its duly authorized officials; each which may be individually referred to herein as a "Party" and collectively as "Parties." Capitalized terms not defined herein shall have the definitions prescribed in the SPP Open Access Transmission Tariff (“OATT” or “Tariff”).
