WHEREAS, CITY and CONSULTANT, pursuant to the Consultants’ Competitive Negotiation Act, entered into an Agreement for Consulting Engineering Services (Small Utilities and Public Works Infrastructure Projects) dated December 16, 2016, as well as a First Extension thereof dated November 6, 2019, hereinafter collectively referred to as the Agreement, by which CONSULTANT provides consulting engineering services for small utilities and public works infrastructure projects related to utilities and public works capital improvement, rehabilitation, relocation and replacement programs for project elements already commenced by Jensen and Group Engineering Consultants, LLC on an as-needed basis pursuant to RFP #15-62DB; and
