On December 18, 2018, California employees in Non-Exempt work unit of National Technology and Engineering Solutions of Sandia, LLC (NTESS) voted by at least a two-thirds majority to implement a new alternative work schedule (AWS). I, the undersigned employee, therefore agree to abide by this AWS and will work either four (4) days of ten (10) hours, if working the 4/10 schedule; four (4) days of nine (9) hours and one (1) day of four (4) hours in each workweek, if working the 9/80 schedule; or four (4) days of eight (8) hours and (2) days of four (4) hours (PM Friday and AM Friday) if working the Standard schedule. The workweek will vary depending on the start time chosen by the employee.

The granting of this “alternative work schedule” is based upon mutual agreement and is approved based upon operational criteria (workload). The undersigned employee understands that: 1) this new schedule does not affect the earning of benefits (sick leave and vacation computed on months and years of service); 2) deduction of vacation, sick leave, or compensatory time (if applicable) is based upon the actual shift (work day) being worked (i.e., 10-hours work day); 3) overtime, if applicable, will be computed based upon hours worked in excess of the employee’s normal work shift; and 4) if the operational needs/work load dictates, management may revoke this agreement and return the employee to a normal schedule of five eight hour work days.

This Agreement must be signed and approved by the employee’s manager and/or department head (if applicable), and department vice president. Offering the opportunity of an alternative work schedule is a management option and is not an employee right. An employee’s participation in the alternative work schedule program is entirely voluntary. The employee or supervisor may terminate the alternative work schedule at any time without cause.
