This Agreement is made and effective upon execution by both Pasco County (COUNTY), a Political Subdivision created pursuant to Florida Statutes, and the State of Florida, Department of Management Services (DMS), a state agency. The COUNTY and DMS shall sometimes hereinafter be referred to in this Agreement individually as a “Party” and collectively as the “Parties.” This Agreement between the COUNTY and DMS is a two-phase project: Phase One concerns the operation of the Old Geiger Road (OGR) Tower and Tower Site (OGR Tower Site), and Phase Two concerns the COUNTY's future lease of property within the county to DMS, whereat DMS may construct and operate a tower.

THIS AGREEMENT is made and entered into this day of , 2010, by and between Southwest Florida Water Management District, a public corporation, in for itself and on behalf of Coastal Rivers and Pinellas-Anclote River Basins, hereinafter called "the District," and Pasco County, Florida, a political subdivision of the State of Florida, hereinafter referred to as "the County."
