THIS AGREEMENT, dated as of , 2019, between Mutual of America Variable Insurance Portfolios, Inc., a management investment company organized under the laws of the State of Maryland and registered with the Commission under the Investment Company Act of 1940 (“the 1940 Act”) (the Corporation on behalf of each series listed in Appendix A to this Agreement, each a Fund), and BROWN BROTHERS HARRIMAN & CO., a limited partnership formed under the laws of the State of New York (BBH&Co. or the Custodian). References to the Fund herein shall be read to include the Corporation on behalf of each Fund or each Fund individually or collectively as the context requires.
