The Bank of New York, in its capacity as trustee of the CurrencyShares Japanese Yen Trust, a trust formed under New York law (the “Customer” or “Trust”) and the London Branch of JPMorgan Chase Bank, N.A. THIS AMENDMENT TO PARTICIPANT AGREEMENTS (this “Amendment”) is made as of the 9th day of December, 2010 by and between The Bank of New York Mellon, a New York banking corporation, not in its individual capacity but solely as trustee (the “Trustee”) of the CurrencyShares Trusts set forth on Schedule A hereto (the “Trusts”) and Rydex Specialized Products LLC, a Delaware limited liability company d/b/a “Rydex Investments” (the “Sponsor”) as sponsor of the Trusts.
