state and local laws and regulations for the duration of the LEASE extension period, the Arlington City Council shall, as contemplated by the Memorandum of Understanding and the Gift Deed dated December 1, 1998, and to the extent allowed by and in accordance with the requirements of federal and Texas law, reconvey the LEASED PREMISES to the LESSEE at the conclusion of the LEASE and any renewal thereof, excluding termination for LESSEE’s default. It is the intent of the LESSOR to convey the LEASED PREMISES to LESSEE at the expiration of this LEASE as long as such conveyance is not prohibited by federal or state law. Prior to conveyance of the LEASED PREMISES, LESSOR and LESSEE shall mutually agree to a method of permanently memorializing both parties’ participation in the Supportive Housing Development. During the term of this LEASE, both parties agree that the interior and exterior signs which are mutually agreed to and placed on the LEASED PREMISES shall remain on the LEASED PREMISES

made and does not make and specifically disclaims any representations, guarantees, promises, covenants, agreements or warranties of any kind or character whatsoever unless otherwise provided for herein, whether express or implied, oral or written, past, present or future of, as to, concerning or with respect to the nature, quality or condition of the leased premises, the suitability of the leased premises for uses allowed under this lease, or merchantability or fitness for a particular purpose. LESSEE acknowledges it has examined the leased premises and accepts such premises in their "AS IS" condition when accepted. Except as may otherwise be provided for herein, LESSOR shall not be required to maintain or to make any improvements, repairs or restorations upon the leased premises or to the improvements located thereon. LESSOR shall never have any obligation to repair, maintain or restore, during the term of this lease, any improvements on the leased premises.
