and a variance is obtained waiving the requirement that ancillary parking be within 500 feet of 300 Hylan Drive. The Mortgagor represents that the parking deficiency has not impacted and will not impact Mortgagor’s ability to operate the Mortgaged Property, there is no enforcement action underway by any governing authority, no penalty has been imposed as a result of the deficiency, and the Mortgagor has never received a notice of parking violations. The Mortgagor has agreed to commence efforts to obtain a variance or parking agreement as noted above within 60 days of closing and diligently pursue to completion thereafter The Mortgage Loan Documents contain a recourse carveout as to any loss sustained as a result of the parking deficiency.
