Previously, pursuant to a Commercial Loan Agreement, dated August 31, 2005, as amended from time to time, between Bank, Borrower and other entities affiliated with Borrower, Bank extended a line of credit to Borrower and those entities (“Prior Line of Credit”), which is being concurrently terminated with the execution of this Agreement.
