Z12. 7 The Employer shall use all reasonable endeavours to ensure that any government department, Contracting Authority, employee, third party or Subconsultant to whom the Consultant’s Confidential Information is disclosed pursuant to the above clause is made aware of the Employer's obligations of confidentiality. Z12.8 Nothing in this clause shall prevent either party from using any techniques, ideas or know-how gained during the performance of this contract in the course of its normal business to the extent that this use does not result in a disclosure of the other party's Confidential Information or an infringement of intellectual property rights.
Z12. If the amount due for the Contractor’s payment of delay damages reaches the limits stated in this Contract Data for Option X7 or Options X5 and X7 used together, the Employer may terminate the Contractor’s obligation to Provide the Works using the same procedures and payment on termination as those applied for reasons R1 to R15 or R18 stated in the Termination Table.
Z12. 3 The security officials must be registered and trained Grade C Security Service Providers in terms of Section 21 of the Private Security Industry Regulations Act, 2001 (Act no 56 of 2001). The applicant (owner, director, member, partner, trustee and administrator) and supervisors must be registered and trained as a Grade A or B Security Service Provider and have a valid registration certificate from PSiRA (Private Security Industry Regulatory Authority). Prior to commencement of the contract, the Security Service Provider will provide proof of all Grade C certificates of the Security Officers
Z13.1 Duvha Power Station is declared a National Key Point (NKP) in terms of the National Key Points Act, 1980 (Act No. 102 of 1980).
Z13.2 The Security Service Provider must be registered as a National Key Points Security Service Provider in terms of the National Key Point Act (Act 102 of 1980).and have valid National Key Points competency certificates. Z13.3 Company’s valid letter issued by SAPS confirming that the company has been screened for registration to provide a security services at the National Key point.
