Common use of Xplor Clause in Contracts

Xplor. does not guarantee any minimum response times in connection with any bank, Card Scheme, Other Payment Service provider, third party payment processor or the completion of any Transaction transmitted and/or processed via the Gateway Services. Xplor will not be liable for any failure of a bank, Card Scheme, Other Payment Service provider, or third party payment processor’s failure to settle any Transaction.

Except to the extent caused by the fraud, wilful misconduct or negligence of Xplor, Xplor will not be liable for any failure of a bank, Card Scheme, Other Payment Service provider, or third party payment processor’s failure to settle any Transaction.
