Written Explanations Clause Samples
The Written Explanations clause requires that certain information, decisions, or reasons be provided in writing. In practice, this means that parties must document and communicate explanations for actions such as contract modifications, rejections, or decisions affecting the agreement. By mandating written records, the clause ensures transparency and creates a clear reference point, reducing misunderstandings and disputes over verbal communications.
Written Explanations. The Plan Administrator shall provide each Participant no less than 30 days and no more than 90 days before the annuity starting date a written explanation of -
(a) the terms and conditions of a Joint and Survivor Annuity;
(b) the Participant's right to make and the effect of an election to waive the Joint and Survivor Annuity form of benefit;
(c) the rights of the Participant's spouse to consent to a Participant's election;
(d) the right to make and the effect of a revocation of an election. The Plan Administrator shall provide to each Participant within the applicable period a written explanation of a Preretirement Survivor Annuity comparable to that provided with respect to a Joint and Survivor Annuity.
Written Explanations. No less than thirty (30) days and no more than ninety (90) days before the Annuity Starting Date, the Plan Administrator shall provide each Participant a written explanation of:

(1) the terms and conditions of a Qualified Joint and Survivor Annuity;
(2) the Participant's right to make and the effect of an election to waive the Qualified Joint and Survivor Annuity form of benefit;
(3) the rights of the Participant's spouse to consent to a Participant's election;
(4) the right to make and the effect of a revocation of an election; and
(5) the relative values of the various optional forms of benefit under the Plan. The Plan Administrator shall provide to each Participant within the applicable period a written explanation of a Qualified Pre-Retirement Survivor Annuity and such other information comparable to the items listed above.

The Plan will provide to each Participant, within a reasonable period of time before the Annuity Starting Date and consistent with Regulations, a written explanation of: (1) the terms and conditions of the Qualified Joint and Survivor Annuity and the Qualified Optional Survivor Annuity; (2) the Participant’s right to make and the effect of an election to waive the Qualified Joint and Survivor Annuity form of benefit; (3) the rights of a Participant’s Spouse; and (4) the right to make, and the effect of, a revocation of a previous election to waive the Qualified Joint and Survivor Annuity.
