WORKERS’ COMPENSATION OFFSET. If an employee is simultaneously entitled to Worker’s Compensation benefits and sick leave, the employee may decline the Worker’s Compensation offset of sick leave usage by giving written notification to their supervisor within three (3) calendar days of the filing of the disability claim. Employees who are using the Worker’s Compensation offset must turn over to the City Human Resources Department all compensation received from the Department of Labor and Industries, which will be used to restore a proportionate amount of sick leave used during the absence. Employees, who exhaust their accrued sick leave or elect not to use the Worker’s Compensation offset, may be placed on leave without pay for a maximum of six (6) months provided the employee is able to return to work.
