WithholdingofCompletionCertificate. If the Independent Engineer determines that the Mines and Equipment or any partthereof do not conform to the provisions of this Agreement, it shall forthwith makeareportinthisbehalfandsendcopiesthereoftoHPGCLandtheMineDeveloperandO perator.UponreceiptofsuchareportfromtheIndependentEngineer and after conducting its own inspection, if the HPGCL is of opinion thatthe Mines and Equipment are not fit and safe for commercial service, it shall, within7 (seven) days of receiving the aforesaid report, notify the Mine Developer andOperator of the defects and deficiencies in the Mines and Equipment and direct theIndependent Engineer towithhold issuance of the Completion Certificate, asthe case may be. Upon receipt of such notice, the Mine Developer and Operatorshall remedy and rectify such defects or deficienciesand thereupon Tests shall beundertaken in accordance with Article-22. Such procedure shall berepeated asnecessaryuntilthedefects ordeficienciesarerectified.
