Common use of Withdrawal and Return of Capital Clause in Contracts

Withdrawal and Return of Capital. Except as otherwise expressly provided herein, no Member shall have the right to withdraw capital from the Company or to receive any distribution of or return on such Member’s Capital Contributions.

Withdrawal and Return of Capital. Except as otherwise expressly No Member shall withdraw any of its capital without the consent of the other Members, except upon the dissolution or liquidation of the Company to the extent provided hereinin this Agreement. Under circumstances requiring or permitting a return of any Capital Contribution, no Member shall have the right to withdraw capital from the Company or to receive any distribution of or return on such Member’s Capital Contributionsproperty other than cash except as may be specifically provided in Section 11.2(d).

Under circumstances causing a return of a Capital Contribution, no Member shall have the right to withdraw capital from the Company or receive property other than cash, except as may otherwise be specifically provided herein, nor to receive any distribution of or return be paid interest on such Member’s Capital Contributionscontributions with respect to the period held by the Company.
