Wind Mitigation Post Construction. The Developer covenants with the Council and TfL:
4.1 The Developer shall submit the Wind Mitigation Post Construction Plan to the Council and TfL for approval by the Council (and approval by TfL to the extent relevant to the TfL road network or London Bridge underground station) following the construction of the exterior of the Main Building and not later than 3 months after first Occupation.
Wind Mitigation Post Construction. 4.1 The Developer shall submit the Wind Mitigation Post Construction Plan to the Council for approval following the construction of the exterior of the Tower and not later than 3 months after first Occupation.
4.2 If the Wind Mitigation Post Construction Plan identifies adverse wind conditions as a result of the Development, the Wind Mitigation Post Construction Plan shall identify mitigation measures which, on approval by the Council, shall be implemented by the Developer within a period of 3 months or such other period of time as may be agreed by the Council. Unless otherwise agreed by the Council, the mitigation measures shall be retained (and maintained) for the duration that the Development or any part of the Development remains Occupied.
