Where ever the word "Vehicle" appears in this Agreement the same shall mean any type of vehicle, trailer or refrigerated trailer and shall be deemed to include therewith component parts and any accessories and ancillary equipment supplied.
Where ever possible, the Corporation agrees to continue its present practices with respect to the provision of protective clothing and safety devices to employees.
Where ever the masculine pronoun is used in this Agreement, it shall be understood to include the feminine pronoun wherever the context so implies, and vice versa.
Where ever the pronoun ‘they’, ‘their’ or other pronouns are used in this Agreement, it shall be understood to include the singular and plural pronoun wherever the context so implies, and vice versa.
Where ever applicable If PAN (Permanent Account Number) of the recipient is not available, income tax is deductible either at the normal rate or at the rate of 20 percent, whichever is higher as per Section 206AA of Indian Income Tax Act 1961.
i) The bidder shall clearly indicate HSN (Harmonised System Nomenclature) / SAC (Service Accounting Code), its description and applicable rate of GST for each item in his techno−commercial bid.
j) Statutory Variation in Taxes & duties as applicable at the time of supply shall be payable. However, in the event of no change in law but bidder quoting certain tax structure in bid document which is lower than the applicable one, such amount shall be the maximum amount of tax that can be claimed by bidder.
Where ever the “Arbitration Board” is referred to in the Agreement, the parties may mutually agree, in writing, to substitute a single Arbitrator for the Arbitration Board at the time of referral to Arbitration. The Chair shall be selected from the list attached to the Collective Agreement as Schedule “E”.
Where ever possible the replacement unit will be an identical model to the original. If this isn’t possible due to the model being superseded, then the latest equivalent will be provided. We will endeavor to match the exact feature set of the original model purchased, but due to continuing advancement this may not be possible, and is not guaranteed. 1.7.Only one attempt to collect will be carried out by the Company, if the Purchaser fails to have the Goods ready for collection at the agreed time then the return of Goods will be the responsibility of the Purchaser.

Where ever possible and appropriate, lead and orchestrate the preparation of technical tender and winning proposal documentation, product demos for customers on site or at marketing events such as trade shows;
Where ever a dispute arises the subject matter of the dispute shall be preserved and the status quo as it existed prior to the dispute shall be retained.
