Watershed. This project consisted of updating the watershed parameters used in the computer simulation of the watershed based on land use changes. The total cost of this multi-year project was $300,000.00, of which the SWFWMD committed up to $150,000.00. The Agreement remained in effect through December 31, 2015, with the SWFWMD managing the project. On March 29, 2016, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-A to extend the expiration date of the agreement from December 31, 2015, to December 31, 2017. Subsequently, on May 8, 2018, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-B to extend the expiration date of the agreement to June 30, 2019. On April 7, 2020, the County and the SWFWMD entered into modification Agreement No. 2013REV0006-C which extended the completion date of Agreement No. 2013REV0006-B from June 30, 2019, to June 30, 2021. At the present time, Agreement No. 2013REV0006-C has expired, but there is additional work required to update the model. This is primarily due to extensive land use changes resulting from new construction activities in the watershed that started after the watershed model was finalized. The parties wish to enter into Agreement No. 2013REV0006-D retroactively, effective June 30, 2021, which would incorporate and amend the language in the prior Agreement, modify the completion dates, performance schedule, and extend the expiration date from June 30, 2021, to June 30, 2023. FISCAL IMPACT/COST/REVENUE STATEMENT: Funding in the amount of $45,695.85 is budgeted and available for FY 2022 in the Stormwater Management Fund, Public Infrastructure Branch, Public Works, Stormwater Management, Other Contracted Services. Watershed. Developer and County acknowledge that County has entered into an Interlocal Cooperation Act Agreement for the Continuation of the Papillion Creek Watershed Partnership, (hereinafter called “Watershed Partnership Agreement” as from time to time amended). The Watershed Partnership Agreement contains provisions applicable to the Property. Specifically, the Parties recognize County’s right to collect Watershed Fees at the time of the issuance of a building permit for the buildable acres within the Property. Said Watershed Fees shall be limited to Lot 1 with no Watershed Fees due on Outlot A. The Watershed Fees shall be collected at the time of building permit application according to the following schedule for commercial/industrial land: July 1, 2015 the Watershed fee shall be $4,497 per acre on Lot 1. July 1, 2016 the Watershed fee shall be $4,609 per acre on Lot 1. July 1, 2017 the Watershed fee shall be $4,724 per acre on Lot 1. July 1, 2018 the Watershed fee shall be $4,842 per acre on Lot 1.
