Common use of WAIVER OF SUBORDINATION Clause in Contracts

WAIVER OF SUBORDINATION. Notwithstanding the terms of Section 13.01, the holder of any such mortgage or mortgages shall have the right at any time prior to the later of thirty (30) days after the date of final execution of this Lease or thirty (30) days after the date of recording of any such mortgage to declare this Lease to be superior in priority to the lien of said mortgage, notwithstanding the respective dates of execution of recording of any such document.
